Privacy Policy and user agreement

I. General Terms and Conditions

1. This Privacy Policy includes those conditions which should be applied when using Communitee.org.com’s buyers’ area. In the aforementioned buyers’ area only the sale of t-shirts and products closely related to them is permissible.

2. By pressing the "I accept the conditions" button you enter into a contract with Buka Media Ltd. (owner of Communitee.org), by which you accept the terms and conditions of usage concerning the Communitee.org website.

3. Communitee.org reserves the right to amend the posted privacy policy and user agreement at any time in the future.

II. Becoming a member, registration, suspension of registration

4. Communitee.org’s online buyers’ area may be used by any individual in possession of his faculties who may enter into legal contracts in accordance of law.

5. During the registration process the user is required to provide valid personal information. In the event of submitting false or partially false information Communitee.org is authorized to cancel or limit the access of the user knowingly engaging in falsification.

6. Communitee.org utilizes the following registration process pertaining to those users wishing to use the online auction service in order to maximize the security of all transactions:

6.1. On the site following the registration the user is placed into a ‘stand-by’ status pending further verification, meaning he is not entitled to upload and/or sell any items.

6.2. Following this, Communitee.org verifies whether the e-mail address provided by the user during the registration is valid or not. The user will receive an e-mail to the address provided which contains a secure link. The link needs to be activated by the user.

6.3. If the user during the registration process provides a bank- or PayPall-account he may also sell items on the site.

7. Registration may be suspended if:

7.1. the user cancels his registration voluntarily or if

7.2. Communitte.org deems that the user acts contrary to the principles and/or specified terms of use of Communitee.org, or uses the buyers’ area not according to the rules as specified below.

7.3. In case the seller wants to cancel his registration he is required to ship all items ordered and confirmed to the buyer, and pay the established commission to Communitee.org.

III. Fees and billing

8. Services provided free of charge are the following: registration, e-mail bulletins and newsletters, usage of topic areas, uploading of t-shirts intended for sale, purchasing.

9. All actual sales carry a fee.

10. Upon all successful sale transactions Comunitee.org charges a commission, which is 10% of the sales price.

11. Following all successful sale transactions Comunitee.org will send an electronic bill (an e-mail attachment in PDF format) to the seller, which he is required to settle within 5 working days.

IV. Communitee.org acting as an intermediary

12. The buyers’ areas on Communitee.org’s site serve solely informative purposes, act as an intermediary, between sellers and buyers.

13. The actual shipping and delivery of purchased items, and the financial compensation given for such activities is carried out completely independently of Communitee.org, being the subject of mutual agreement between the users involved. Payment for items purchased on the Communitee.org site is executed either by bank transfer or via PayPal account.

14. For the quality, safety, and legality of items appearing for sale on the site Communitee.org has no oversight and thus is in no position to take responsibility for any deficiencies that may emerge in the items. Furthermore, Communitee.org does not take responsibility for the originality of the items appearing on the site and for the actual successful purchasing of items by buyers and sales by sellers.

15. Communitee.org can not and will not guarantee that the transactions between sellers and buyers reach a mutually satisfying conclusion. Since Communitee.org does not in any way interfere in the negotiating process between prospective buyers and sellers, in case of emergence of any sort of disagreements by accepting this privacy policy and user agreement all involved parties waive any claims for compensation regarding Communitee.org.

16. Communitee.org is authorized to use for promotional purposes any illustrations and pictures uploaded to the buyers’ area by any users.

V. Method of buying and selling

17. For executing sales the user needs to register as a seller with a genuine name, and valid address, e-mail address, billing address, and bank account or PayPal account number

18. For executing purchases the user needs to register as a buyer with a genuine name, and valid e-mail and billing addresses. For the purchase of every single item a valid bank account or PayPal account number must be provided.

19. It is the responsibility of the seller to ship the purchased item or items to the buyer and to execute the billing for the proper sum.

20. Payment is to be carried out by direct bank transfer from the buyer’s account to the seller’s account.

VI. Users rights and responsibilities

- The seller upon registration is entitled to upload and offer for sale any items.
- The seller is required to describe in the prescribed length the exact features and characteristics of all items uploaded in the space provided on the site as realistically as possible.
- The seller is required to ship within 10 working days from the time of purchase any items under the same conditions as advertised. Shipping and handling charges are to be covered by the buyer.
- The seller is not allowed to alter the terms of sale, which cannot be under any condition changed unilaterally by the seller following the execution of a successful sale.
- The seller is required to pay Communitee.org a 10 percent commission of the actual sale price upon the completion of every successful sale.
- The buyer is required to purchase any item ordered and settle all charges fully and expeditiously.

VII. Comments

22. The users of Communitee.org provide feedback to one another. The rating of any seller or item offered could be done by using a scale of 1 to 5. All ratings should be formulated upon careful consideration since the rating results are public for all users of Communitee.org and cannot be altered under any circumstances following their posting. Anybody degrading unjustly the good reputation of any other user will be held responsible for such deeds, which may entail the taking of legal actions against such irresponsible individuals.

23. Communitee.org does not take any responsibility for the content of opinions and comments voiced by any users appearing on the site.

VIII. Limitations

24. Communitee.org reserves the right to suspend any user; or cancel and delete any order, transaction, or item; or delete any information or comment appearing on the site which is contrary to the principles of Communitee.org, or the proper terms of usage of the buyers’ area, or is in opposition to Communitee.org’s user agreement list of criteria seen below; furthermore could be regarded as malicious, unethical, and illegal. With the suspension or cancellation the item will automatically cease to be on the list of products offered on the site.

25. The posting of any information is not allowed which:
is not related to Communitee.org, e.g. private comments on individual users or any postings about commercial transactions which have been carried out outside the realm Communitee.org; includes links to other webpages (other online stores and markets, and websites of commercial content), and images, except those which contain information for the description of the items offered for sale including weblinks; contains the personal data of users or calls for the dissemination of such data; is obscene, and contains vulgar language, and information which may offend other users; is aimed to systematically defame other users; is related to any non-public information connected to Communitee.org or concerns other sites of similar profile.

26. It is forbidden to offer for sale at Communitee.org’s buyers’ area any item which carries illustrations that: may offend the religious sensitivities of others, or could be seen as calling for discrimination based on sex, race, ethnicity, origin etc., is an obvious symbol of dictatorial regimes, may be used for instigating hatred, and intimidation, infringes on any applicable laws, can be viewed as a commercial advertisement.

IX. Moderating principles on Communitee.org’s info areas

27. The forums of Communitee.org primarily serve the purpose of allowing users to share with one another their experiences, opinions, and innovative ideas concerning Communitee.org’s services including any purchases made previously, and all other topics relevant to the usage of the site and the buyers’ area (arts, design, communications etc.). The topics generated on Communitee.org’s forums will be moderated according to the following guidelines. We kindly request all users to post their comments upon the careful reading of the moderating principles and obeying their content to the fullest possible extent!

28. The following activities are not permissible on the site: Releasing or making public any registered user’s personal data which may infringe on his anonymity (name, address, place of work, phone number, e-mail address); posting the links of any websites with commercial content; and posting VOIP access codes or numbers (Skype, MSN, Googletalk, ICQ, bank account numbers, etc). Posting any comments which could be viewed as threatening, aggressive and of harassing nature and which negatively affect the positive spirit of the forum community. Any technical interference which alters the topic area’s scope, appearance, and size and harms its normal usage protocol is deemed undesirable and not permissible. Comments which are abusive in content, are unrelated to the topic, and interfere with the normal postings due to their foul language or any other intentionally malign activity will be censored. The using of vulgar language for the purpose of defaming other users. Any topics which serve clearly the purpose of maligning the reputation of other users using unfair and vulgar language. If a registered user complains about a topic in which he is debased under the terms as described above he may request Communitee.org to censor or entirely remove the topic area under discussion even if it does not otherwise come into conflict with the rules of this user agreement. In such cases Communitee.org has the right to decide what course of action should be taken concerning the topic. Posting any comments which may offend the religious sensitivities of others or may be used for incitement based on ethnicity or national affiliation and may qualify as hate speech and are of intimidating nature. Posting of commercial advertisements. As commercial advertisements qualify all such topics and comments which advertise any product, service, webpage, job vacancy, or profit oriented business. All such topics and comments will be deleted. The links of webpages of public utility may be shared e.g. postal shipping rates. Posting comments which are of illegal nature. Posting any information that infringes on any applicable laws in force in Hungary and which call for the violation of all such laws.

29. For the actual content of comments Communitee.org does not take any responsibility; however if a given comment is in violation of any laws, Communitee.org may delete it without any further justification. Communitee.org entitles its forum moderator to censor and/or delete those comments which violate the terms of use as stipulated above. The continued violation of the principles of usage as state above will result in the complete ban of the violator from Communitee.org’s forums.

X. Privacy protection

30. The user by submitting his registration request agrees that Communitee.org, in line with the privacy protection laws, will handle his personal data as it appears on the registration form. Only that information will be used which is necessary for identification purposes; for informing other users; for the continuous development of marketing and advertising activities; for the widening of offered items; and for the creation of a more user-friendly site.

31. The user upon registration agrees to receive a periodical newsletter from Communitee.org to the e-mail address provided on his registration form; however he is free to unsubscribe this service at any time.

32. Communitee.org saves the personal data of users only for the permissible timeframe, with the cancellation of a registration the personal data files will be deleted simultaneously.
